Art Hunter, S.L. (hereinafter also AHC) puts the arthunterclub.develoop.net website at the disposal of internet users free of charge.

Access and/or use of the arthunterclub.develoop.net website is completely voluntary and confers the status of USER on whoever does so. All USERS accept, from the moment they access the site, without any limitation, the content of these “General Terms and Conditions of Use”, the “Privacy Policy” and, where applicable, the “Special Conditions” that may supplement, replace or modify them in some respect in relation to the services and content of the PORTAL. As a result, it is the responsibility of the USER to read all of them thoroughly before accessing and using any of the services of the website.

The USER can access, print, download and save the General Terms and Conditions of Use at any time. These Terms and Conditions will be permanently available on the Website via the Legal Terms and Conditions link.

The purpose of this PORTAL is to create a market where visual artists from around the world can publish and sell their pieces to users who are interested in art. Our website provides information on everything that may be of interest to the customer: promotions, offers, shopping facilities, etc.

 

  • Services provided

The following services are available to USERS who register through the website’s registration form:

  • The Site provides Sellers with a market service that allows them to establish references and put their Works up for sale at a price they themselves determine, as well as to accept the purchase offers submitted by the Buyers; to collect the amount of the selling price; to organise the delivery of the Works; and to manage the after-sales service for the Works that are sold.
  • Sales performed through the Site are executed directly between the Buyer and the Seller. AHC is by no means a reseller of the Works made available by the Sellers through the Site.
  • Art Hunter S.L. acts as an intermediary solely within the framework of the service provided by the Site, which facilitates contact between Sellers and Buyers.

Accordingly, Art Hunter S.L. is not part of the contract that is entered into exclusively by the Buyer and the Seller, the latter of which is the sole seller of the Works and solely responsible for the obligations resulting therefrom.

Art Hunter S.L. will only disclose the data and/or information provided by the USER to other users when such data and/or information do not infringe legal regulations or these General Terms and Conditions of Use.

 

2.4     Terms and conditions for access and usage of this website

 

Users access this website at the own exclusive liability and, if they do so, this means that they are aware of an accept the legal notices and the terms and conditions for usage contained thereon. The website www.arthunterclub.com does not guarantee that the prices of the articles will be the current ones when viewing the website. ARTHUNTERCLUB reserves the right to make as many changes and modification that it sees fit for the website at any given time and with no prior warning.

The User undertakes to correctly use the website and the features provided thereto in accordance with the Law, this Legal Notice and the instructions and notices that they receive.

  • incorporates, shares or allows access to products, elements, message and/or services that are criminal, violent, offensive, harmful, degrading or, in general that that go against the law, morality and public decency generally accepted or part of civil order;
  • is false, ambiguous, inexact, exaggerated or untimely in such a way that could cause confusion about the subject thereof or about the intentions or aims of the person making the communication;
  • is protected by any intellectual or industrial property rights held by third parties, unless the User has previously obtaining the necessary authorisation for the use that they make or intend to make from the holder of such rights:
  • breaches third-party trade secrets;
  • goes against the right to honour, personal and family privacy or people’s image rights;
  • in any way detracts from the reputation of Art Hunter S.L. or third parties;
  • breaches regulations on secrecy in communications;
  • where applicable, amounts to illegal, false or unfair advertising or in general, amounts to unfair competition:
  • includes viruses or other physical or digital elements that could damage or impede the normally functioning of the network, the system or the digital devices (hardware and software) owned by Art Hunter S.L. or third parties, or that could damage digital documents and files stored on such devices;
  • by nature (such as format, file extension, etc.) leads to difficulties in the normal running of the service.

In accordance with the foregoing, the User undertakes to use the contents provided thereto on the website, which are deemed to be, but not limited to, the texts, photographs, graphics, images, icons, technology, software, links and other video or sound content, as well its graphic design and source code, (hereinafter referred to as the “Content”), in accordance with the law, this Legal Notice, all other notices, usage regulations and instructions provided, as well as generally accepted morality and public decency, and public order; as such they undertake to abstain from:

The User must refrain from obtaining or even attempting to obtain the Contents by using means or procedures other that the ones that, depending on the case, have been provided for such purpose or have been stipulated as such on the website on which the Content is hosted or, in general, those that are generally used on the internet for such purpose, as long as they do not involve risk for the damage or disabling of the website, the Services and/or Content.

Specifically, the use of image and audio/video files owned by Art Hunter S.L. are subject to the following terms and conditions: They must not be used for commercial purposes and/or subsequently distributed. Images and video resources available here are available for the exclusive use of the media and for merely informative purposes, as long as the origin is stipulated. As such, it is prohibited to use them to depict the activities, products or events of other companies. Art Hunter S.L. reserves the right to withdraw the permission to use any of these images or audio/video files when it deems that they are being in used in such a way that damages their interests.

Art Hunter S.L. can delete any illegal content from its website with no prior notice.

Access to the ARTHUNTERCLUB website is unlimited; however, the owner reserves the right to suspend access to any Users who, in their opinion, do not comply with the rules for using the website and take the necessary legal action.
